2026 TEAM ALZ PARTICIPATION WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT AND FUNDRAISING AND PARTICIPANTION AGREEMENT
ASSUMPTION OF RISK; RELEASE OF LIABILITY; ASSUMED OBLIGATIONS
In consideration of being allowed to participate in the Team ALZ, a group of individuals that have elected to raise funds for the Association, while training for and running in the TCS New York City Marathon, including all related fundraising activities, training activities, meetings, events and programs (“Team ALZ Program”) I, the undersigned, understand, acknowledge, appreciate and agree to each of the items below. I acknowledge that Team ALZ Program is a completely voluntary undertaking for which I will decide how and when I participate.
1. I am at least 18 years old and of sound mind.
2. By participating in Team ALZ Program, I understand that my activities are solely at my discretion, and I acknowledge that the Alzheimer’s Association will have no control or direction of any kind regarding my activities. As a result, any and all risks associated with my activities are mine to determine, and I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, associated with participating in Team ALZ Program, regardless of how such risks may arise and regardless of whether such risks are covered by my personal health insurance or other types of insurance. I assume full responsibility for my participation in the Team ALZ, which may include marathon training, organized or independent training runs, fundraising activities, travel to and from events, participation in the TCS New York City Marathon, and related endurance activities. I have been informed and understand the risks of training for and running in a marathon, which may include, but are not limited to: Cardiac events, including sudden cardiac arrest, during training or the race; musculoskeletal injury: sprains, strains, stress fractures, tendon/ligament tears, joint damage; heat-related illness: dehydration, heat exhaustion, heatstroke; cold-related illness: hypothermia, frostbite (if outdoor training in winter); falls, collisions with other participants, or trip/slip hazards on training routes or race course; overexertion, fatigue-related impairment, or loss of consciousness; injury or complications due to uneven, wet, icy, or poorly maintained running surfaces, traffic and vehicle exposure on training routes not run on closed roads, weather (extreme heat, cold, lightning, severe storms), and air quality (pollution, wildfire smoke); actions of other participants, spectators, or volunteers (collisions, crowding) and independent third parties (the race organizer, host city, aid station staff); and transportation to/from training sessions or the race, if Association-arranged.
3. I acknowledge and agree that I, and I alone, am solely responsible for my personal health and safety and personal property while participating in the Team ALZ Program.
4. I agree that I am solely responsible for determining that I am physically capable of participating in the Team ALZ Program as I am determined to do so. If I am aware of or under treatment for any physical infirmity, ailment, or illness, I acknowledge that it is solely my obligation to obtain my medical care provider’s approval to participate in Team ALZ Program, and I shall maintain personal health insurance while participating in the Team ALZ Program.
5. I understand and acknowledge that the Alzheimer’s Association has no role, power or direction over the TCS New York Marathon or any operation, administrative or promotional matters related thereto.
6. In order to promote, share and archive Alzheimer’s Association programs and events like Team ALZ Programs, I acknowledge, agree and irrevocably consent that any photographs, videos and/or recordings that are taken during my participation in the Team ALZ Program may be use by the Alzheimer’s Association in furtherance of its activities, and to this end, I grant, in perpetuity and on a royalty-free basis, the Alzheimer’s Association, its chapters and their directors, employees, officers, agents, representatives and licensees, all rights to use and
publish for promotional and internal purposes in all media, now known or hereafter developed, my name, image, likeness and voice as well as any statements, quotes, or other biographical data provided by me to the Alzheimer’s Association, in whole or in part, and to copyright any materials created. I hereby waive any right to inspect, approve, or be compensated for the use of any materials incorporating such images and information. I release the Alzheimer’s Association, its chapters, and their directors, employees, officers, agents, representatives and licensees from all liabilities arising out of any use of my likeness and information as provided above. I understand and agree that all negatives, digital images, and recordings of my likeness, regardless of form, are and shall remain in property of the Alzheimer’s Association.
7. I, on behalf of myself and my heirs, assigns, personal representatives, administrators, estate and next of kin, HEREBY KNOWINGLY AND VOLUNTARILY, IRREVOCABLY AND FOREVER: (i) RELEASE Alzheimer’s Association, Team ALZ Program, each sponsor of Team ALZ Programs, each funding partner of Team ALZ Program, each of the foregoing parties’ respective affiliates, and each of the foregoing parties’ respective current and former owners, partners, members, officers, directors, trustees, advisors, consultants, employees, agents, volunteers, officials, representatives, successors, assigns and other participants (collectively, “RELEASEES”), FROM ANY AND ALL LIABILITY WHATSOEVER, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY AND ALL INJURIES, DISABILITIES, DEATH, LOSSES OR DAMAGES TO PERSON OR PROPERTY, ARISING DIRECTLY OR INDIRECTLY IN CONNECTION WITH MY PARTICIPATION IN the Team ALZ Program REGARDLESS OF THE CAUSE THEREFOR, to the fullest extent permitted by law; (ii) WAIVE MY RIGHT TO SUE OR MAKE ANY DEMAND WHATSOEVER against any RELEASEE for any damages or losses arising, directly or indirectly, in connection with my participation in Team ALZ Program; (iii) AGREE NEVER TO SUE ANY RELEASEE asserting any claim for damages or losses suffered, directly or indirectly, in connection with my participation in Team ALZ Program; and (iv) AGREE TO INDEMNIFY AND HOLD EACH RELEASEE HARMLESS from any and all claims, demands, suits, damages, expenses, costs, liabilities, judgments, settlements and losses of any and every kind suffered or incurred by any RELEASEE and arising, directly or indirectly, in connection with my participation in Team ALZ Program.
8. I understand this Waiver and Release of Liability and Assumption of Risk Agreement inures to the express benefit of the RELEASEES and may be relied upon and enforced by any RELEASEE. I also understand that the effectiveness of this Waiver, Release of Liability, and Assumption of Risk shall indefinitely survive my participation in the Team ALZ Program.
I STATE THAT I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT. I ACKNOWLEDGE THAT I FULLY UNDERSTAND THE TERMS OF THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY AGREEING TO THE WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT. I AM AWARE THAT BY SIGNING THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, I AM AGREEING TO ALL OF THE TERMS OF THE WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, INCLUDING WAIVING SIGNIFICANT LEGAL RIGHTS. KNOWING ALL OF THIS, I AGREE TO THE WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT IN ITS ENTIRETY FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
FUNDRAISING AND PARTICIPATION TERMS
1. By participating in the Team ALZ Program and the TCS New York City Marathon, I agree to help raise funds for the benefit of the Alzheimer’s Association and research treatments and a cure. The deadline for receipt of all fundraising for the Team ALZ Program is Friday, December 4, 2026. I acknowledge the registration fee is non-refundable but is a tax-deductible donation to the extent allowable by law and will be applied to my fundraising total. I acknowledge there is no fundraising minimum required as a participant in the Team ALZ Program. I acknowledge that earning Team ALZ Program fundraising recognition prizes will be determined based upon my fundraising total by the deadline of Friday, December 4, 2026.
2. I understand that any registration fee that I make is not refundable or transferable even if I do not or cannot participate in the Team ALZ Program for any reason whatsoever, including, but not limited to, any illness or injury that may preclude my participation. I understand and agree that I am not permitted to grant another person the right to participant in the Team ALZ Program in my place under any circumstances. I agree to contact Team ALZ Program staff should I need to back out of the Team ALZ Program and/or the TCS New York City Marathon.
3. I accept and understand the Alzheimer's Association Matching Gift Policy as follows: Many companies offer a matching gift program that matches employees' charitable contributions. It is my responsibility to inquire with my employer about matching gifts and request my donors to do the same with their respective employers. For a matching gift to be applied to my fundraising total, I need to complete and submit the Alzheimer's Association's Matching Gift Form along with copies of any applicable documentation submitted to my company to tphillips@alz.org by Friday, December 4, 2026. Upon receipt of the required form and documentation as well as the matching gift donation itself, the Alzheimer's Association will credit the matching gift to my personal fundraising page. Notwithstanding the foregoing, I acknowledge that matching gifts are reliant upon the processing times of the company matching the gift, which can take significant time, and I acknowledge and agree that if the matching gift has not been processed and received by the Alzheimer's Association by Friday, December 4th then any such matching gift shall not be credited to my personal fundraising total, and I will be liable for any outstanding balance remaining on my fundraising minimum ($5,000 per bib) as a result of the matching gift(s) not being processed and received by December 4, 2026.
4. I understand that I am free to use the “Team ALZ” name only in a nominative context in my fundraising efforts in connection herewith, and as expressly permitted in any official Team ALZ Program mobile application, website program, or similar context, but that my participation in the Team ALZ Program does not convey to me any ownership interest in the Team ALZ name or trademark, or any other trademarks owned by Alzheimer’s Association or Team ALZ, and my use of such marks may be further restricted or prohibited by Alzheimer’s Association for any reason and at any time.
5. The Alzheimer’s Association is committed to providing an environment free from harassment and discrimination. The Alzheimer’s Association strictly prohibits harassment and discrimination based on race; creed; color; religion; gender; sex; sexual orientation; national origin; ancestry; age; veteran status; citizenship status; marital status; physical or mental disabilities; pregnancy, gender identity or expression (including transgender status); and any other characteristic protected by federal, state or local law.
I STATED THAT I HAVE CAREFULLY READ THE FUNDRAISING AND PARTICIPATION TERMS SET FORTH ABOVE. I ACKNOWLEGDE THAT I FULLY UNDERSTAND THESE FUNDRAISING AND PARTICIPATION TERMS. I AM AWARE THAT BY SIGNING THIS AGREEMENT, I AM AGREEING TO ALL OF THE FUNDRAISING AND PARTICIPATION TERMS SET FORTH IN THIS AGREEMENT. KNOWING ALL OF THIS, I AGREE TO THIS AGREEMENT IN ITS ENTIRETY, FREELY AND VOLUNTARILY.
By participating in this event, I've committed to raising awareness and funds to advance the care, support, and research efforts of the Alzheimer’s Association®.
Currently, more than 6 million Americans have Alzheimer's disease, and that number is expected to grow to nearly 13 million by 2050. Our future is at risk, and we must come together to change the course of this disease.
